Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of BuilderX ERP (“the Platform”), owned, developed and managed by Beacon Coders (www.beaconcoders.com, “Beacon Coders”, “we”, “us”). By accessing the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. The service

The Platform is a multi-tenant, subscription-based CRM for real estate builders and developers, covering pre-sales, post-sales, inventory, payments, channel partners, HRMS and related modules. Access is provisioned to an organization (“Customer”) under a separate order or agreement with Beacon Coders, and the Customer’s administrator creates and manages accounts for its own employees and channel partners (“Users”).

2. Accounts & access

• Users are added to the Platform by their organization’s administrator; there is no public self-signup.
• Each User is responsible for keeping their login credentials confidential and for all activity under their account.
• Access is role-based; a User’s permissions are determined by the role assigned by their administrator.

3. Acceptable use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to access data belonging to another organization or another User without authorization.
• Interfere with, disrupt or attempt to gain unauthorized access to the Platform or its infrastructure.
• Upload malicious code or use the Platform to store or transmit unlawful content.

4. Customer data ownership

As between Beacon Coders and a Customer, the Customer retains ownership of all Lead, buyer, booking, financial and other business data it or its Users submit to the Platform (“Customer Data”). Beacon Coders processes Customer Data solely to provide, secure and support the Platform, as described in our Privacy Policy.

5. Third-party integrations

The Platform supports optional integrations, including Meta (Facebook/Instagram) Lead Ads. Where a Customer connects a third-party account, the Customer is responsible for ensuring it has the right to share that data with the Platform and for complying with the third party’s own terms (including Meta’s Platform Terms and Advertising Policies). Beacon Coders is not responsible for the availability or behavior of third-party services we integrate with.

6. Intellectual property

The Platform, including its software, design and branding, is the property of Beacon Coders and is protected by intellectual property laws. These Terms do not grant any ownership rights in the Platform to a Customer or User beyond the right to use it as provisioned.

7. Confidentiality

Each party will use the other’s confidential information only to perform its obligations under these Terms and any related agreement, and will not disclose it to third parties except as permitted here or required by law.

8. Warranties & disclaimers

The Platform is provided on an “as is” and “as available” basis. Beacon Coders does not warrant that the Platform will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Beacon Coders will not be liable for any indirect, incidental, special or consequential damages arising from use of the Platform. Our aggregate liability under these Terms is limited as set out in the applicable subscription agreement with the Customer.

10. Termination

Access may be suspended or terminated for breach of these Terms, non-payment under the governing subscription agreement, or at the end of a Customer’s subscription term. Upon termination, access to the Platform ends and data is handled per our Privacy Policyand the Customer’s agreement.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the courts having competence over Beacon Coders’ registered place of business.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Platform after an update constitutes acceptance of the revised Terms.
